I am currently awaiting DNA testing to find out if I am the father of a child who is 4 years old. I just finally got a great job and I am worried that the state is going to take alot of my earnings for child support. What I am wondering is, what is the percentage of my income that can be taken? Also, any tips on getting this amount reduced? If the child is mine I of course want to help out but I have to support myself and my other child as well. Any help on this would be appreciated.

This may get a bit long. You are correct that in Missouri you can get a state order for child support without going through the court. In fact if you applied for any aid programs through the Division of Social Services you will be required to first seek child support. They will order a paternity test to determine if the claimed father is indeed the father. After paternity is established both parents will need to fill out standard income and expense forms and using a standard formula the amount of child support is determined. Normally at that time insurance is considered and if one of the parents has employment with an employer that subscribes to an insurance plan they are required to enroll the child and the monthly payments are figured into the formula. If neither has that option then the order may still be put in place but is not enforced (you can't enroll in what doesn't exist). If that's the case one of three things can happen. The child has no insurance, one parent purchases private insurance and is given credit for it, or once enrollment criteria is met the child can be enrolled in MC+. Since this all may be determined after the initial child support order is entered the parent may need to request an administrative hearing to get the order adjusted. Everything described so far is just dealing with the state bureaucracy on financial issues. They will not deal with custody/visitation issues.

Although a lot of young people tend to go the above route or use informal arrangements the best and usually the eventual route is to hire an attorney and go to court. As part of the court process new more comprehensive financial forms will be filed and a court determination on child support and insurance will be reach that will supersede the state's determination. More importantly in my opinion both parents will file a parenting plan and a determination will be reach as to how custody will be shared including visitation and how decisions on schooling and other maters get made.


Basic bottom line if your brother pays for insurance it should get figured in his share of support (not necessarily dollar for dollar) but he will probably need to request an administrative hearing or go to court.

1. If you have child support in arrears, both your federal and state refunds can and will be captured to offset your child support debt.

2. You are married now so you can NOT file as Head of Household. That's off the table entirely. You have two choices: Married Filing Jointly and Married Filing Separately.

3. Filing jointly will result in the lowest total tax.

4. Filing separately will normally result in much higher tax. Doing that to avoid the support offset would be INSANE. That would be giving the GOVERNMENT money instead of your CHILDREN. If you think that that's preferable, you need processional counseling.

5. If your new spouse also works, file a joint return and have her attach a Form 8379 to protect her share of any refund. Your share will be offset for your child support obligations. You cannot stop that.

In missouri, how long can child support enforcement hold a payment that was made by withholding income taxes?

my exhusband had his income tax money withheld by the state becasue he owes back child support. It shows in case file that the child support division has recieved payment but they have yet to disburse payment to me. It has been almost 3 weeks since they have had it. How long does this process typically take.

I can't seem to get a straight answer from anyone.

She could only have done that in the initial filing. She has not grounds for a retroactive order, but it could increase your future payments. I say could as all child support is rebuttable. I'm in the KCMO area.

NOTE: Missouri does allow for five years of retroactive child support on new child support filings in paternity cases. Most states have that provision. A few allow up to 21 years worth, and four do nto allow any.

Indeed.  There are actually very few things that can prevent a U.S. citizen from getting a passport, but owing over 2.5k on back child support is one of the most common.  And without a U.S. passport, it will be difficult for you (presumably a U.S. citizen) to travel or immigrate anywhere.The child support collection process is automated to the extent that a passport will be denied to a non-custodial parent in arrears, without any additional paperwork.  In other words, nobody lifts a finger and the ban shows up in the system as soon as one crosses the 2.5k USD threshold.In my experience, most non-custodial parents who find themselves in this situation are able to get out of dodge by either contacting and negotiating directly with the custodial parent (not always feasible or advisable), or by providing evidence for an amendment to the original court order of support (usually based on a material change of circumstances).  Thanks for the A2A, User-11978101981914353371.

im very shocked that they "whiped" his c/s away, never heard of that one before..

Fact is , if he's "unable" to work for medical reasons then he will get "disability" there has to be a source of income somewhere for him to be able to survive himself.. and they are suppose to take out a percentage from his disability , or work mans comp. or unemployment checks which ever the case is to give u child support, granted ur child support will be lowered but somethings better then nothing.... are u going through child support enforcement in your state? if not, i suggest that u do.. if he owes child support they will take any and all refunds he gets from his taxes to give to u if he's actually working.. they can look up his social security number to find out if he is working and if he is, they can garnish his check.. also usually if u have to go to the state for any assistance.. usually that will light a fire under the states butt to go after ur x as well , since its his responsibilty to care for his children and not the states.. good luck
