Yes, they can arrest you. And police do not need a warrant or notice if there is probably cause of a crime in progress. That would include marijuana smoke in the hallway.

The likelihood of this actually happening varies depending on where you live (state and neighborhood). The MS might get you off the hook, but that's risky.

If you can't give it up due to medical reasons, sit by a window and blow the smoke outside.

I fully agree with you. The fact that you can get arrested for using necessary medication in your own apartment is outright flawed. The fact that you can get a prescription for Oxycontin or morphine but not marijuana is mind-boggling. But, unfortunately, what is right doesn't match what is on the books. Still, the chances that anything will happen are fairly small. But be careful, none of this changes what I originally said.

And I do feel for you. I may be starting some medical treatment soon, and the doctor brought up medical marijuana to offset side effects. I'm not looking forward to that idea, but I certainly don't want the government to interfere if it will help.

First off being in a apartment is be respectful to neighbors. Don't throw loud parties cause that will for sure get the cops there alot faster than some weed smoke. Always turn down your music and TV after 10pm-7am. Make sure to have fans(window fans) taking smoke out of your apartment and not blowing it in the direction on a neighbors window. Have a highpowered airfreshener or spray to mask the smell and greet cops outside your apartment and lock the door behind you. Second, possession of a "pound" of weed will not be considered possession they will most likely lump that in as possession with intent to distribute. A pound has 16ounces. That is alot of weed. If they claim you are intending to distribute that is a felony offense with possibile jail time of 16mouths-3 years. It is not a simple fine.

Simple possession of over 28.5 grams (That is just 1 ounce) is a misdemeanor 6 months jail time and up to $500 fine.

Possession of up to and including 28.5 grams of marijuana is an infraction punishable by a fine of $100. So keep less than 1 ounce and you should be good.

A pro-tip would be to get your medical card so if cops do come to your house you can say you are a licensed medical user and here is your card.

If my neighbors call the cops for me smoking weed on my own property can i be arrested?

I like to first start by saying Im nineteen I live in city north of Boston MA, in a three family apartment and ive be smoking weed since I was 16 . I go to college and work full time and by all accounts im a productive member of my community. BUT just the other day my buddy and I were smoking a joint in my car parked in my drive way when one of the other tenants walked over to my car and demanded I stop smoking pot or they would call the police and have me thrown out of my home! Their reasoning being my pot smoke was traveling from my car into the halls, up two floors, and into there child's bedroom getting the kid high as kite. I tried to reason with her telling her there is no way her kid could get high and that weed was decimalized and I was not breaking any law she refused to listen to reason and proceed to harass me.

So my question is... is this ***** for real? And am I at any risk of losing my home and freedom for smoking on property I pay good money to rent?
Anyone with legal knowledge on this situation your insight would be greatly appreciated!

Strange: I’ve talked to many non-smokers who like the scent of burned cannabis, including a Panamanian roommate in college who adamantly refused to let me smoke cigarettes, but was fine with pot. But, apparently you have strange olfactory issues, whatever… Firstly, I’d advise you just treat this as any strong odor, as if your neighbors cooked fish a lot (this is often an issue for neighbors of recent South Asian immigrants), or burned incense. Actually if you found an incense scent that you don’t mind, you might even ask your neighbors to use it. An acceptable solution for everyone.When you bring up the fact that it is marijuana, you’re bringing up emotional issues (if not legal problems) for pot smokers, getting them defensive when they might be sympathetic. Many smokers would be understanding about bad smells, that’s how I would bring it up with landlord/apartment manager or even (God forbid) the police if they get involved somehow. Pretend you don’t know that it’s cannabis, just that it’s just an odor that bothers you. I think this would even work on a Quora search. You may find answers and solutions here that get lost when you make it an issue about cannabis, instead of just a strong odor you dislike. Especially if your neighbor is using cannabis for medical reasons. PS: cannabis is the preferred term for medical use, since it served this purpose for hundreds of years before prohibitionists used the term “marijuana” to capitalize on prevalent racism against Mexicans.

I can smell my neighbours smoking pot!?

My family and I recently moved into a somewhat crappy duplex since my mom lost her job. Since there are 3 of us living here and it's a two bedroom place I have set up my room in the garage. Our neighbors smoke pot what seems like all day long and it's making me sick. I'm having severe headaches and getting queasy. It is only noticeable in the garage and while in the bathroom. I'm afraid they have medical marijuana cards and I'm wondering if there's anything I can do about it for them to stop. I can't block any vents or under any doors, its just through the walls. They never leave their house and the only time I've seen them standing on their porch they looked completely high. I'm afraid to talk to them and just need good advice please.l

I have successfully smoked weed in my room with no repercussions for some time now.Although my parents know and generally don't have a problem with me smoking weed (better than being an alcoholic or prescription drug abuser, right?) They do not like me smoking in my room for the reason of lingering smell and the fact that it is (stupidly imo) illegal.So, if I do feel like having a smoke I'll usually adhere to a few “rules” to make sure that I don't get caught green handed.Only smoke after they have gone to bed (or during a free house)Make sure you go toilet and stock up with snacks and water/drinks before you smoke so that you have no need to leave your room whilst still 'airing' out the roomPut a towel, old jeans or tracksuits along the bottom of your room door and also cover the keyhole (if you have one) with a jacket or something.Make sure to have your windows (or balcony door) wide open during your smokeLeave the windows/balcony door open for as long as possible after you smoke (30/45 minutes at the very least) (I have a designated smoking blanket for those cold nights)It may sound obvious but don't go and make a lot of noise and start screaming out laughing or coughing your lungs out so loud that your whole street hears it. (I'll usually watch something or play some games with headphones on)And don't over do it! I mean I love me a smoke but a second joint or bowl or whatever in your evening session alone is usually just overdoing it and means you have to worry about the smell a lot more.If you stick to those rules you should never really have an issue.For me this has worked very well but you must realise that I have a relatively small room with a large balcony door which allows for a lot of air circulation and parents who aren't expressly trying to catch me out (after all, they do know that I'm somewhat a connoisseur).Also, I smoke joints so if you're ripping a bong or vaporising, chances are that the smell will be less of an issue for you than myself meaning you don't have to have your windows open for as long a time.Ultimately I would recommend that you cut down on smoking in your room and save that money for a trip to Amsterdam or a legal state in the U.S. where you will notice an incredible leap in quality and a experience a much more relaxed smoking environment.Hopefully that helps!

What part of my life needs turning around?Anyway when I smoke I do so in my back yard so my Nan doesn’t have to smell it.Unfortunately, that means my neighbours saw me smoking pot and, coupled with my night owl characteristics, decided that I must be a drug dealer. So they did what you are thinking of doing; they called the police.I wasn’t there when they started the raid on my Nan’s house, I was on the way back from a job interview. When i got there they were halfway through the job of looking for evidence of my supposed dealing activities. My Nan was a wreck, she has never been in any sort of trouble in her 89 years on this earth and was happily gardening when more than a dozen police officers burst into her house looking for drug dealers. She was in mild shock; confused and upset. The police were very good to be fair to them, they made her a cup of tea and chatted with her until I turned up. At the point when I turned up they had deducted that I was no dealer and the neighbours had jumped to conclusions based on their moral outrage of me smoking a joint. Basically finding my personal stash and nothing more. Even though it’s illegal in my country they didn’t even bother taking the weed which shows the level of interest that it garners.Seriously grow up, get your own life and stay out of other peoples. It doesn’t affect you in the slightest if they’re smoking weed on their property.An amusing story did come from this, and illustrates how seriously the British police take firearms over here. While the police were searching for drugs they look under my mattress and discover a black plastic toy pistol (I had put it under there months previously because my kids had been arguing over who should play with it and I had hidden it from them) They couldn’t touch it at all, they had to call a rapid response firearms team to my house, as they are the only police qualified to handle firearms, to verify it wasn’t a real gun. Which was obvious but rules are rules!

Sometimes yes we can. It all depends.Back in January, 2017 a neighbor called that she could smell the odor of burning marijuana emanating from her next-door neighbor’s apartment. We responded to the location. It wasn’t my call. I was acting as the cover officer. As soon as we got out of our cars we could smell the marijuana. Last January was very cold and snowy and everyone had their doors and windows closed and the odor was still very strong — that’s pretty impressive. So we made contact with the calling party and she directed us to the right apartment. We knocked on the door like the gentlemen we are and, incredibly, the door opened.We were slammed in the face by a wall of marijuana smoke. I could barely see that there were three men in the room behind the homeowner who had thoughtfully opened the door to us. They were smoking a couple really pretty, and expensive, glass bongs (Oregon is next door and there is a head shop just a little ways across the state line). They were all in their late fifties and just kicking-back watching the NFL AFC Championship game (New England Patriots vs. Pittsburgh Steelers), smoking some grass, drinking beer and eating pizza.The responsible officer explained to the occupants why we were there and asked if they were indeed smoking pot. They said yes they were and let us into the apartment when we asked if we could come in (the other officer and I are big believers in the soft approach first). We confiscated the bongs and pot, and the primary officer issued them a summons for possession of a controlled substance. The homeowner also got a ticket for possession of drug paraphernalia (the two bongs which he stated were his). They were all nice guys and it was obvious they were very experienced pot smokers. I kept the door open since the air was so heavy with pot smoke. It was making me a little sick actually. We thanked them for their cooperation (I felt like we were British cops) and left. The whole call was very civilized.

I caught my child smoking pot.... again?

I caught my child smoking pot for the second time. The First time I threatened to kick him out of the house if he did it again. He is 16 and I told him he couldn't smoke in my house. I threatened to kick him out on the streets. He just shrugged and said "okay". He left and moved in with his 18 year old friend. I was so surprised. What should I do?

I will look weak if I run back asking him to move back in. He is still going to school and he still maintained his 3.57 average last report card. Hes a stoner, with phenominal grades? I dont understand it.

It looks like he doesn't really need me or his mother, and I didn't want to be too hard on him, but I chased him out. I feel terrible even though hes probably smoking marijuana right now.

His teachers called us the other day to comment on how well he is doing in school and I almost cried. Should I bed him to come back, or let him stay in that apartment with his 18 year old friend? I have no idea
