No, you will not go to jail. In my city, the fine and court costs are about $500-600. If you are an employee of the business, you will probably be fired. The business will have to go before the city Beer Board and will possibly be fined and be put on probation. If this is a repeat offense by the business, it could lose its license to sell beer. It doesn't matter if it was an accident or intentional. It doesn't matter if it was a police check or a regular customer. It was against the law.

Hi. A couple of days ago I accidentally sold alcohol to a minor in one of those ABC stings. I live in Virginia. I asked for the ID but I misread it and didn't type in the exact birthday. If this wasn't worse enough, I had two stings in a row and I sold to them both :(. I was fired on the spot and have to go to court and pay a fine. I feel really terrible about it and it's the biggest mistake I've ever done. Is there ANY way I could get rehired? The only thing I can think of that would help my case is that I wasn't informed about the stings by my supervisor when everybody else apparently was. No, things are not quite that cut and dry. There are various factors that go into deciding exactly who is punished, and to what degree, if a minor is served alcohol. First of all, although all states do have a 21 year old minimum for buying and drinking alcohol, it is not a federal law. This means that each state is free to create its own laws, punishments, and agencies. California, for instance, has the Alcoholic Beverage Control (ABC), which is responsible for drafting and enforcing the provisions of the liquor license.

Each state's agency will have specific enforcement provisions about the punishments for violating a liquor license. In general, the agency is free to revoke a license for ANY offense, even a first one, but in practice they will usually give first time offenders a fine, warning, and/or a suspension of the license (usually a week or so). If the offense is particularly blatant, the license may be revoked, however. Also, if you are cited for selling to a minor again within a year of your first citation, many boards automatically revoke your license (some states allow 3 times in one year).

Upon receiving a citation, you can request an administrative hearing to present your side of the story and any mitigating factors you might have, or can agree to the punishment and submit.

So, The craziest thing happened today. We were busy as hell at the liquor store that I work at and this guy comes up, whom I found out was not a guy it was in fact an underage shithead. Now, let's talk reality...and with honesty. Your life isn't ruined, but it's facing a crisis situation. It is time for damage control. Do Not plead guilty! There are lots of reasons that there is an option (not always, but in most cases - yours included) to plead "no contest" (nolo contendere for those that think it makes them sound smarter by saying it that way).

As to sentencing, a plea of gulity and a plea of no contest are the same. But there are major differences otherwise. Your options then, are, No Contest and Not Guilty.

You say you're going to court tomorrow. That means you are having an arraignment hearing. That's all. No trial tomorrow. No evidence hearing. No cop who busted you. Nothing. Not tomorrow anyway.

Tomorrow you will be on time, wearing dress clothes, respectful of and to the court (specifically the judge who you will address in a clear, calm manner as "Your Honor") and you will enter a plea (after you are called forward from the gallery to stand before the bench) after the judge asks you two simple questions:
"Do you understand the charges filed against you?" and,
"To those charges, how do you plead?"

Your answers will be:
Yes, Your Honor. and,
Not Guilty.

Clear?

You will then scrape together money from whatever (and I do mean whatever) legally allowable methods you must and retain legal counsel!!!

You have too much at stake - and no criminal record (traffic tickets are not part of a criminal record) - to do anything other than what I have described.

You are going to get through this - not completely unscathed, but not "ruined" - and get on with your life goals!

So i stupidly didn't ID a minor today at work. Had i actually known they were a minor of course i would not have sold them it but that's not the point. The point is i did it and i am willing to accept responsibility for it. I will pay my fines and learn from my mistake. I just really need to know am i going to lose my job.
