Can I file a police report for threats?

Yes you can. Just be sure to have ALL details, and if possible any and all witnesses to such threats, if possible, to collaborate your claim (story), as it’ll be your word against that of the person who made the threat(s) against/to you.It would even be beneficial in your behalf if you can get an audio recording of the threat(s) or even written (copy/ies) of the threat(s) if done in that manner to add to your report to the police.Verbal, written or other forms of threats against another person or persons, especially if threatening death or any form of bodily harm, is taken very seriously by any police agency and will be investigated to the fullest. The more and better the proof you can provide them, the better and sooner they can bring the person issueing the threat(s) to justice and in getting them convicted if/when found to be guilty of such threat(s).

Should I File a Police Report on my Neighbor? Threatened to Kill me?

About a month ago, I slammed my door and my upstairs neighbor came down and threatened me.
He said, "You best stop that, you little skank or I'm calling the police!"
I told him whatever and about an hour later went upstairs to try to talk with him because I'm the type of person to not like conflict.

He then threatens to "f**** kill me" and "snap my f**** neck in half".

I told my husband about the argument but not about the threats, and I'm afraid that now he wouldn't believe me because it's been so long.
He already made it clear he didn't want to get involved in any conflict, so I figure I best take matters into my own hands.

A few nights ago, my mom was coming to pick me up for laundry and she unknowningly was in his parking spot for a few minutes.
He gets out and says, "THE BEST THING YOU CAN DO IS GET OUT OF MY F**** PARKING SPOT!"
My mom tells him not to be so rude and he repeats himself and while at first I didn't take his threat too seriously, now I'm beginning to fear for my safety.
This guy is about five times my size (I'm a girl) and in terms of physical strength he could seriously injure me.

What should I do?

I already plan to talk to my landlord about this.

I hate to have anyone kicked out of their home, but I can't move once my lease is up on account of the fact that I cannot afford it financially and because I live right across from my college and I can't drive.

Any advice is greatly appreciated.

Yes! It is called an Incident Report. The normal procedure is for the police to speak with the alleged perpetrator, let her know she cannot do this, and warn her not to continue to make threats. IF this person continues, the police can step in and put an end to it via a restraining order issued by a judge or magistrate. They can, with a court order, put a tap on your phone... not to record the threat, but as long as you do not hang up your phone, this person cannot make or receive another call. Then the phone company traces the call and the police know who it is. This is done quite often when people call at all hours and then hang up which are called nuisance calls...and also illegal. Strangely, nuisance calls are usually always someone you know.

ok so my friend had a treatening phone message and she is not sure what to do. it showed up as a private number and they went though one of those voice changer things but we think it sounds like one of my ex boyfriends (why he would cll her i dont know..) does anyone know how we can find out what number called her, and how do you think we should handle this situation. the message went something like: "hello jill" (i changed her name for the sake of privacy) "i know where you live, if i were you i would be awake all night watching out your window because i am coming to your house to kill you"

No, it’s not illegal merely to threaten to call the police with what you consider a “false accusation”. I’ve both taken these calls on 911 lines, and responded to them in the field. Calling first doesn’t mean anything at all. Many times I’ve (and any other cops) responded to a call and arrested the person who called 911. They almost always say “but I’m the one who called” or “I’m the one who called first”. Often, while one person calls, the other person also calls to “tell the real story”. People think that if they call, they’re going to automatically be granted victim status I guess…In your case, I don’t know if you mean they are threatening to call right this minute for something they allege is going on, or they texted you they’re going to tell the cops you’re a drug dealer at sometime in the future. In any event, it’s up to the police to investigate and determine if a crime occurred, and if so who committed it.. If someone knowingly, on purpose, just wanted to jam you up because they don’t like you for some reason, lied to the police, and made a false report of a crime..then they can be charged with making a false police report. Telling me about it first doesn't do much.. I’ve had people tell me that so and so might call to say I beat my kids, beat my dog, beat my wife, but I’m getting to you first so you’ll know it’s a lie. So when they call, you won’t waste your time on their lies. How do I know it’s a lie before it has been investigated? Also, keep in mind some stuff is subjective. Turns out you spank your toddler. Your neighbor who thinks all spanking is child abuse threatens to call the police.. If your neighbor says you’re abusing your kid by spanking him, it’s up to the police to determine if the spanking crosses the line into child abuse per CA penal code 273a/273b. You may consider it a “false accusation” but they may have reported what they thought was a crime in good faith. In that case, they would not be in trouble for making the false accusation.Hope that helps.

Threatening Prank Calls?

So I just got woken up at 1am from a silly prank call on my cellular phone. I keep my phone number guarded, so this doesn't happen often but tonight's events were particularly annoying. The caller sounded like a teenage kid trying to act gangster and even though I didn't answer he left a long voicemail cussing and threatening to kill me and blow up my house.

So, whatever. I roll back over in bed and 15 minutes later the same thing with another voicemail. Ugh I say to myself... I'm more peeved that these punks are making late night threatening calls than the fact that they are pranks. It doesn't really bother me if its say a group of drunk people trying to have a laugh.

Question is - should I bother *57 them and taking on the $20 fee to have police send them a letter? I did save the voicemails. Maybe I should just ignore it completely? Like I said, I can have a good laugh with some prank callers but threatening ones are just way over the line... especially twice.

If he calls again, make a record of what is said in each phone call, as you may need to refer to it later. If it continues, I would inform your local police, so they can monitor it and see if there's a pattern.

Don't respond/ engage with the caller as this is what they want, and it will encourage them to continue. Here is some more info.

What can the police do if someone threatens to hurt you?

Not much really. Generally they make contact, tell the other person to knock it off. If it’s a really elaborate threat or they make an attempt to complete on the threat they might get a ticket. If they’re doing it by phone, possibly a ticket for harassing phone calls. It’s pretty much a non event.Assault and battery are what most people think of in this situation. ‘Assault’ is the threat of unlawfully touching another. “I’m going to kick your ass.” is assault.Battery is the actual touching. So if he says it, and then pushes you, hits you whatever, you have basic a&b.Unless the other person is on probation or parole, you’re not getting jail time out of either. You get a citation and told to knock it off.You aren’t going to get a protection order based on a simple threat. You’re expected (I’m assuming you’re an adult) to deal with adult things on an adults level and figure them out. Not run to the judge every time you feel bad. Even then in general a restraining order is a civil document. You can petition for it but it by itself if granted is just a piece of paper. It’s not a charging document, it’s nothing. If you call the police and report that someone violated your restraining order, not a damn thing the police can do besides tell you to talk to your attourney. You’ll have to go to court and prove the restraining order was violated and then the judge may act.A protection order IS a criminal document and can be acted on by LE. If someone beats the crap out of you more than likely they will be give an order to stay away from you during their sentencing. If they violate that they can be arrested on site for violation of a court order. 2 vastly different documents.YMMV and different locations call the same things different things, but in general thats how it works.
