He’s never going to have “control of the Supreme Court” - that just isn’t how it works in the USA’s constitution.There is some degree of overlap between the “travel ban” issues and the Bush administration’s attempts to deny all legal rights to Gitmo detainees. Even with a theoretical 5–4 conservative majority, the Boumediene v. Bush - Wikipedia decision went against the administration, with Justice Kennedy joining the more liberal justices for a 5–4 majority.In that case, Chief Justice Roberts dissented, but argued that the legal process available to Gitmo detainees was an adequate substitute for Habeas Corpus, thus avoiding the question of whether they were entitled to those rights. It’s not 100% clear that Roberts would side with Trump’s executive order, which as it stands appears to grant no process at all for individuals to challenge the ban.It has also been noted that in the area of executive-branch regulations, Judge Gorsuch has been in favor of aggressive judicial review, rather than granting deference to the executive branch. That might or might not indicate that he would also be skeptical of Trump’s claims to unreviewable authority.*If* Gorsuch is confirmed, *and* one of Ginsburg/Kennedy/Breyer were to leave the court, *and* Trump were able to replace them with a strongly-deferential-to-executive judge, then he might have a clearer shot at winning this. But that may never happen.
