What is the original intent of the US constitution?:)?

"Original Intent" is a term used to describe the interpretation of the constitution.

It means that you take it at it's word based off of what the original writers intended to say.



The meanings of words change over time, so to fully understand the constitution, you need to consider what the founders actually meant in their own words.

Are you required by the Constitution to have a driver's license in order to drive on public roads?

I have wondered before if you really need the approval/permission of the government/state in order to drive a privately owned vehicle on public roadways. I have found several references both in Supreme Court rulings and in the Constitution itself that agree private travel-including driving is a right that cannot be prohibited or under state approval.

"The use of the highway for the purpose of travel and transportation is not a mere privilege, but a common fundamental right of which the public and individuals cannot rightfully be deprived." Chicago Motor Coach v. Chicago, 169 NE 221.

"The right of the citizen to travel upon the public highways and to transport his property thereon, either by carriage or by automobile, is not a mere privilege which a city may prohibit or permit at will, but a common law right which he has under the right to life, liberty, and the pursuit of happiness." Thompson v. Smith, 154 SE 579.

"The right to travel is a part of the liberty of which the citizen cannot be deprived without due process of law under the Fifth Amendment." Kent v. Dulles, 357 US 116, 125.

"The right to travel is a well-established common right that does not owe its existence to the federal government. It is recognized by the courts as a natural right." Schactman v. Dulles 96 App DC 287, 225 F2d 938, at 941.

"The state cannot diminish rights of the people." Hertado v. California, 110 US 516

"Statutes that violate the plain and obvious principles of common right and common reason are null and void." Bennett v. Boggs, 1 Baldw 60 U.S. Supreme Court

Why did the anti-federalists wanted the Second Amendment included in the Constitution?

Anti-Federalists — they were fearful of a centralized government; any centralized government.Every American should know that each state is essentially it’s own sovereign nation — it’s own independent country with its own laws.That was a challenge for a fledgling nation under the Articles of Confederation; which essentially bound the original 13 colonies (states) together in support of each other’s defense using independent free militia men from each state would would bring their own guns and munitions to the battlefield.Anti-Federalists, like Thomas Jefferson, wanted the absolute smallest federal / centralized government as absolutely possible to ensure the rights of the people and the states would not be infringed. The way to that was to insure the right of the people, who made up militia, who were necessary to maintain a free State (nation, rather than independent state) — to keep and bear arms and for that right of the people never to be infringed.The federalists believed that the Constitution enumerated powers to the federal government — so it said the the federal government only had “THESE” specific powers. They believe the states and the people would resist any encroachment outside of the powers.The anti-federalists, in their infinite wisdom, demanded the individual bill of rights, the first 10 amendments to the constitution, that further outlined 8 additional things the federal government could NOT do to any citizen without an amendment to the constitution. The other 2 amendments essentially said, that the constitution is not meant to be narrow — but broad in its interpretation that any power not given to the federal government lies with the people or the states to do for themselves — in essence, you have no right to do anything except these things. One of these, was the second amendment, which was the RIGHT OF THE PEOPLE TO KEEP AND BEAR ARMS SHALL NOT BE INFRINGED.But had this been in the constitution in the first place, rather than an amendment, is actually irrelevant — because any amendment to the constitution is actually apart of the actual constitution because Article V allows the constitution to be amended, but not changed. If any change is going to occur, it must come through the form of an amendment that repeals a previous clause and / or creates a new statute.This way, history and posterity see all the battle scars of where we started and how we got to where we are.
