Why isn't marital rape punishable under the Indian Penal Code?

I too had the same question. I have a retired judge in my colony and when I talked to him about several issues, I was shocked. He told me that most of the active  feminist organizations have now put more concerns on the increasing misuse of law by women. Many feminist organizations he knew are now in a stand-still situation because the women themselves are not giving proper support. Then I asked him about what he meant, he said that in his whole career, he has seen too many cases where many men were falsely accused of rape and he had a hard time dealing with such cases. The law regarding Marital rape is not being passed, not because of men but because of women themselves. That day was an eye-opener for me. I learned that while there are many misogynist men out there, there is also a section of society within women that is misusing the law so much that it has become difficult for the feminist organizations and those who work for women empowerment to push for reforms. Hypothetically assuming that Marital Rape law exists, the only way for an innocent men to protect himself from rape charge would be to have a written consent before having sex every time. That too I think would be ruled out as the woman can say that the men pressurized him to sign consent. Laws like this in other countries are pretty straightforward and they don't have to face such issues from women side. Things become too much complex if women who misuse the law don't stop doing it. Otherwise, there is no hope.
