How do people not get caught shoplifting?

I'm not asking how can i steal and not get caught but I don't understand how people can get in a store, take some stuff, and get out with no problem. Beside the moral side of stealing how can people not see them commit the act, every store i go there is cameras and I've always assumed there was people watching those cameras so people don't get away with shoplifting. I don't think its hard to see people take stuff off a shelf and see them not put it back.

I am an attorney and I know a lot about this subject. Do not take this as creating an attorney-client relationship. You may, however, find it helpful.

I won't judge you, dear. Many good people find themselves caught up in this type of situation. There may, however, be legal consequences to this, which you need to be prepared for. That is why I am answering your post.

You say that the police were called but you don't say whether or not you received a citation or other paper which requires you to appear in court. If you have not already received a citation, then, probably, you will not receive one. I can't be certain of that, because sometimes people are charged with a crime after they are released, but usually they are charged with the crime on the spot, particularly when the police are called.

If you did receive a citation to appear in court (or receive one later) you absolutely must talk to an attorney experienced in criminal matters about this. An attorney may be able to defend you if your friend was the one who actually stole something. Also, even if you have no real defense, in some states the charge can be reduced to a non-criminal infraction and in many more states first offenders can qualify for a "diversion" program. If you are allowed into diversion and you successfully complete the program requirements, at the end of the day the case is dismissed and you have no criminal record.

Do not expect judges, prosecutors, police, or court staff to give you good advice. It is not their job to protect your interests.

Another thing tha may happen is that you and your parents may receive a "civil demand" letter from the store, saying that you owe a penalty. The amount of the penalty may be many times the amount of the stolen merhandise. Usually, attorney fees can be added to the penalty if you don't pay, and that may be many times the amount of the penalty. Generally, it is better to pay the penalty than risk the cost of fighting it. If you have or do get charged with a crime, however, you should talk to the attorney about the penalty before paying it.

Well, hopefully neither criminal nor civil penalty consequences will result. If they do, however, make sure you talk to an attorney to minimize the consequences of this mistake.

How do shoplifters get caught after the fact?

I was indicted 2 years after the fact in a theft from Wal-Mart. The actual theft was a success, however due to video cameras, social media, AND physical evidence they were able to pin the theft.This is my theory on how you can get charged after the fact. Say you're stealing something, and you get away with it, however you are on security footage, sure they can ID you by your image, but can they determine what you stole and how much it cost by video footage alone. Furthermore do they have any evidence that you did indeed steal the item. Let's face it, if you dont have the item currently, you can tell them you never did it, and it's your word vs. A video camera. It's not sufficient evidence to charge someone with theft. So now say you steal an item, but you take it out of the wrapper and you leave the wrapper behind, you get out of the store, BUT now you are on camera AND they have a physical representation of items stolen. This is enough to charge you with theft, the same can be said for those attempting to steal, who are stopped on the way out the door, if you run, you still can be charged with theft… if you leave evidence behind. And most loss prevention will not stop the pursuit until they have their merchandise..

I was a professional shoplifter for a long time. By professional, I mean, it was my source of income, and the only. I was on a student visa, and I was only allowed to work for a limited time. I discovered shoplifting, how to not get caught and how to sell what you lift. I use to make $2000/week cash (equivalent in the local currency, in Europe). Dedicating about 16 hrs a week, including stealing and selling. ‘So I found an easy way to make money and fund my education and also live in luxury. Then I grew old and stopped it. Thinking about it now, I cannot do it again. I was young and reckless. Now, I would shiver doing it. I was totally fearless at that time.I used to shoplift expensive electronics like LCD TVs, DVD recorders etc. The technique I used, was discovered by me through trial and error. And how to sell at the maximum price. I have searched a lot on the internet about various ways people do it and still haven’t found my method. So I plan to keep it a secret, in case I need to do it again some time in future. If I have financial difficulty or something.I never stole from independent stores but only very large chain stores like Walmart which have very large weekly sales, so missing a few hundred dollars just disappears into their allowed shrinkage per week. (I also worked in a supermarket, so I know about the inside things and the numbers. Also about security.)
