Are there any loopholes or mistakes in the 1951 refugee convention(MUN)?

Like all conventions, the 1951 Refugee Convention was a product of its time. Europe had been torn apart by war and this convention was drafted with Europeans in mind. The 1967 Protocol broadened it. The Convention is elastic enough to remain relevant - for example, it was not drafted with LGBTI individuals in mind but covers those facing persecution who have fled to other countries. The Convention is specific to refugees - the drafters did not imagine there would be a time when internally displaced persons far outnumbered refugees. It is highly unlikely there will ever be an IDP Convention although there are guidance documents and regional instruments such as the Kampala Convention. Regional conventions are probably the best we can hope for. The 1951 Refugee Convention far preceded awareness of climate change and the potential for environmental displacement related to it. There is no such thing as a climate refugee according to international refugee law but nor is there clarity regarding the responsibilities of the international community to those who have been partially or wholly displaced due to environmental reasons. We have lost many of the world’s traditional refugee champions (USA, Denmark, etc.) due to populism and xenophobia. Were the 1951 Refugee Convention re-opened, as some countries want it to be, it would almost certainly be watered down.

Do refugees have the right to come to the USA or is it a privilege?

Neither, the character of the debate has plunged to moronic levels based on these kind of positions.No one has a legally established right as a refugee to enter the USA just if they feel like it.There are established US laws and international agreements on the right to seek asylum and the treatment of refugees. Rules and regulations which the nation of the USA chooses to sign up to and has done under both DEM and GOP regiemes. These are little changed since the 1950s, its not a new thing.The notion of privillage is bollocks, the notion of gratitude in obtaining shelter and succor from the generosity of the US Govt when faced with persection, famine or war is another thing.A refugee is obligied to behave in accordance to the laws of the USA, the state and local district and no more or no less than any US citizen. They are to be treated without fear or favour regardless of if the were born there, migrated there or arrived as refugees.I live in a nation where if I break the law I can have my citizenship revoked and be deported. Even if this is during a civil protest which in the end turns out to be correct. So one has to excercise a degree of caution that is not required in the US where everyonenis more equal in the face of the law when a citizen. It is not a privilege to live here its good or great.

Why can't India help people in Syria?

So I thought about reading into it much more deeply rather than dismissing it as a just another middle east thing. All done, read how the civil war started and who are all fighting. Different countries, different sects of islam, Isis, radical islamic groups, rebels, Iran, Israel, kurdistan, battles of aleppo, raqqa etc., And finally now renewed seige of eastern ghoutta.As much as I hate to say this, syria is a radical shithole. Now, I am all for peace and rebuilding the country. I saw all the images people say has been clicked in Syria and my heart bled for them. And for a Tamil these images brought back all the images of tamil genocide in sri lanka and that’s the main reason I guess those hastags are spreading in TN. And later when I was scrolling through newsfeed I saw Esha gupta tweeting about these new bombings.Then I wanted to read about India’s role in Syria. And this got my eye. Syria hesitant about India’s role in reconstruction after Modi’s Israel visit. The Syrian government of Assad which has all the support of India hesitant to ask us to play a role for reconstructing their war torn country ! . All because PM Modi embraced PM netanyahu. Esha gupta as expected trolled by us Indians asking her to look inwards into our country first. Esha Gupta replied the trolls through a dramatic tweet that almost accused us of bombing eastern ghoutta and we are not sympathetic to those children’s plight because they are muslims. She said humanity is above religion and borders. But after seeing Syria’s stand and practicality I thought, “humanity was never above religion or borders”. Sums up our reasons does’nt it.!
