What should I do if I accidentally broke my friend's phone?

You should offer to pay for the repair of the phone or a replacement phone. . Hopefully your friend carried insurance on the phone, so that the cost of the repair or a replacement phone will be offset in total or part.If the phone has to be replaced, you can work out the cost of the new phone you are responsible for with your friend. My friend was using my phone and the it accidentally fell from his hand and the screen got badly broken. He is now willing to pay 50% of the repair charges even though I didn't ask for it. Should I take the money or not as it was also not his fault?

It depends on your friendship with him.He has been your close friend and have been with you in your bad times.Gave you shoulder when you had breakup.And is always ready to help then you should not take it.But if he is causual friend and not serious then you should take it. By law if you want money from another individual and he/she does not agree you must go to court. This is very painful, long and expensive procedure almost nobody does for cheap phone.Ethically if you put the phone somewhere where stepping on it is very likely even ethically this person is not responsible. If you put it somewhere away (shelf, on top of locker) and somebody was doing silly things (like fooling around like crazy with friends) and hit the locker and due to that phone fell off then ethically he/she is responsible for acting unreasonably in a place where it should not be done. Like gym or dressing room.If she/he doesn’t want to pay you can call police to get the fact fixed on paper. He/she might get nervous and accept the damage and pay. But he/she doesn’t have to without court. It is civil dispute, not criminal. Police can’t force those things.

I know if I borrowed someone’s phone and damaged it in some way, I would offer to have it repaired or replaced (whichever was cheaper). Something else to consider is the age of the phone. If it is a model no longer offered, I certainly wouldn’t offer to buy a newer model as a replacement.An argument could be made, however, that you accepted the risk your friend might damage the phone when you loaned it to him. He certainly isn’t legally obligated to repair or replace it. A good compromise might be for you to accept part of the blame for borrowing it to him in the first place and offer to split the cost of repair or replacement in half.This is also why it is a good idea to have an extended warranty on your mobile devices. Whether you or someone else drops it, paying a small deductible to get it fixed beats having to pay full price.

SUMMARY:
I accidentally broke my friend's 2 year old flip phone. He says that I am entitled to buying him a brand new one (the same kind of phone), which will cost $230. I said that is not reasonable and that I will buy him a used one that is in similar condition as his old one.

OK, it is a small crack, and the phone still works. But your friend, who did this, does not offer to somehow make the repair. The answer depends at lot on his finances, in my opinion. If he is really operating on a tight budget, I would be inclined to overlook the problem. But if he has ample means, eating out a lot, etc., then he should totally take financial responsibility for fixing the phone. If he does not (in this situation) he is more of a parasite than a friend, and deserves to be treated accordingly.

Can I sue someone for accidentally breaking my phone?

An accident is that which can not be foreseen and which has no intent. Therefore negligence and recklessness are difficult to pursue. if the person was holding your phone, with your permission, lightning struck a tree causing a branch to fall knocking the phone from the person ... this is an accident and there is nothing you can do.
If the person grabbed your phone, without your permission, in the same incident, they are responsible because BUT FOR their taking your phone the branch would not have hit it.
You can sue the person in the last case but not in the first case.
If you let them use it in good faith and they broke it, they have breached your good faith and breaking it was not a condition of you letting them use it. ie he dropped it or spilled something on it. He has a duty to pay for it to be repaired. I am surprised he does not offer to repair it.
This depends how strong and ruthless you want to be. If you want to mess around then you will not get it repaired. If you are direct and tell him he is responsible he must pay for its repair or a new phone and he refuses, you can sue him.

Accidentally Broke Someone's Phone...?

I was playing with some friends and things got a little chippy and he claims I cracked his phone and I have to pay him for a new one. What's the worst that can happen to me if I don't pay him (I don't think I cracked his phone) and could their be any legal action against me?
